Agreement to Terms
By accessing or using the services provided by Blue Coast Web Services ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services
Blue Coast Web Services provides web design, web development, website management, business automation, and related digital services. The specific scope of services will be outlined in individual project agreements or proposals.
Project Agreements
All projects will be governed by a separate project agreement or proposal that outlines:
- Scope of work and deliverables
- Project timeline and milestones
- Pricing and payment terms
- Revision policies
- Ownership and licensing rights
In case of any conflict between these Terms of Service and a project agreement, the project agreement shall prevail.
Payment Terms
Unless otherwise specified in a project agreement:
- A deposit may be required before work begins
- Final payment is due upon project completion
- Late payments may incur additional fees
- We reserve the right to pause work on projects with outstanding balances
Client Responsibilities
Clients agree to:
- Provide accurate and complete information necessary for the project
- Provide timely feedback and approvals
- Ensure they have the rights to any content provided to us
- Make payments according to agreed terms
- Comply with all applicable laws and regulations
Intellectual Property
Client Content
You retain ownership of all content, materials, and intellectual property you provide to us. By providing such content, you grant us a license to use it solely for the purpose of completing your project.
Deliverables
Upon full payment, clients receive ownership of the final deliverables as specified in the project agreement. We may retain the right to display completed work in our portfolio unless otherwise agreed.
Third-Party Materials
Some projects may incorporate third-party materials (stock images, fonts, plugins) subject to their own licensing terms. We will inform you of any applicable third-party licenses.
Revisions and Changes
The number of revisions included in a project will be specified in the project agreement. Additional revisions or scope changes may incur additional charges. Significant changes to project scope after work has begun may require a new agreement.
Warranties and Disclaimers
We warrant that our services will be performed in a professional manner. However, we make no guarantees regarding:
- Specific search engine rankings or positions
- Specific business results or revenue increases
- Compatibility with all future software or platforms
Services are provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.
Limitation of Liability
To the maximum extent permitted by law, Blue Coast Web Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
Termination
Either party may terminate a project agreement by providing written notice. Upon termination:
- Client shall pay for all work completed up to the termination date
- Deposits are non-refundable unless otherwise agreed
- We will provide reasonable transition assistance
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the termination of any agreement.
Indemnification
You agree to indemnify and hold harmless Blue Coast Web Services from any claims, damages, or expenses arising from:
- Your breach of these terms
- Content you provide that infringes on third-party rights
- Your use of the deliverables
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Brevard County, Florida.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
